The Instituto Nacional da Propriedade Industrial reports that Portugal has recently launched a new portal on anti-counterfeiting with online complaint. This Portal is bilingual (Portuguese and English) and provides general information and statistics on counterfeiting, ways of legal protection and contains useful information.

The report and recommendations on Injunctions (Articles 9 and 11 of the Enforcement Directive 2004/48/EC) issued by the Legal Sub-Group of the EU Observatory on Counterfeiting and Piracy have been released on the Observatory’s web page.

In his non-binding opinion the Advocate General advised the Court that the Border Measures Regulation does not contain a ‘production fiction’ and that customs may seize fakes in transit if there are sufficient grounds for suspecting that they are counterfeit goods.
