New trade mark legislation in Dominica

Ten years after its enactment, Dominica’s Marks, Collective Marks and Trade Names Act 1999 came into force in February 2009.

This new piece of legislation marks a break between the Dominican and the UK trade mark registers.

It includes the latest version of the Nice Classification and allows the registration of service trade marks.

On the enforcement front, the Act specifies up to 12 years’ imprisonment and/or a fine of up to XCD 40,000 (approximately EUR 10,570) for the infringement of a registered trade mark, as well as the seizure, forfeiture or destruction of the infringing goods. Civil remedies, injunctions and damages are also available.
